This policy applies to all users who have purchased any kind of service module from our website ranging from hosting, domain, ssl, vps, dedicated server or any other service or its addons.

Consent

By purchasing any service module / product from our website, you hereby consent to our Terms of Service / Usage policy and agree to its terms unconditionally as they are.

Overview

This Terms of Service Agreement (this “Agreement”) is entered into by and between the relevant Huts Industries group entity indicated below (“byteistic”) and you, and is made effective as of the date of your use of this website (“Site”) or the date of electronic acceptance.

Eligibility

The site and its services are available only to users who qualify on the below mentioned criteria:

The applicant / buyer / user shall be over the age of 18 years.
The applicant / buyer / user shall not be a barred from purchasing, using or receiving the service as per the Indian Jurisdiction and / or the jurisdiction of their own country of living.
The person shall not have any banned account under same or different name in any of our partner websites or on this “site”.

If you are entering into this agreement by making an account on behalf of any corporate / non corporate entity like a private limited company, trust, NGO or any other, you hereby confirm to have rights to represent the entity and have the legal authority to bind into this agreement on behalf of the entity, in this case, the terms “You”, “Your”, “User”, “Client”, “Customer”, “Entity” shall refer to the entity and not to any specific person representing it, people representing the entity shall be terms as “Account Manager”, “Representative” and “authorized personal”.

If in case byteistic finds that you do not have the right to enact as the Representative of the entity, the account shall be subject to seizure which could be unlocked post confirmation from the entity subject to our internal standards of verification. If you fail to do so, the account shall be suspended and / or terminated. In this case, no data backup shall be retained and byteistic shall not be liable to any loss or damage to the entity or to the falsely claimed authorized person of the organization.

If there is reasonable doubt about the authenticity of any such instruction, notice, document or communication in personal or entity account. Byteistic reserves the right (but undertakes no duty) to additional authentication from you until the internal verification criteria is fulfilled. You further agree to be bound by the terms of this Agreement for transactions entered into by you, anyone acting as your agent and anyone who uses your account or the Services, whether or not authorized by you. You agree to share verification documents in an un-masked format issued by the governing state of your country for verification purpose which shall be safely saved in our records for lifetime as long as the service is indefinitely closed, in such events, the record’s unique number might be retained for upto 5 years period post the deletion of the original file shared by the entity or the client.

Accounts and Security

In order to access any of our segments or services, you are required to create an account with us. You confirm that all information given to byteistic for both personal or corporate account is accurate, correct and complete and that you will keep the account information updated all the time. If byteistic has a reason to believe that your information is untrue, inaccurate, out-of-date or incomplete, we reserve the right to suspend your account that shall be unsuspended if and only if you provide documents to prove the information accuracy subject to fulfillment of our internal verification parameters. If the same is not received within 48 hours of account suspension, the account shall be liable for immediate termination which would result into deletion of all data present in any / all the services owned by the account for which no data backup shall be provided and the loss or damage incurred shall not be claimed upon byteistic. We recommend users to perform a password change for their account in every 4 months, 3 times a year for better safety, any unauthorized access or breach of security shall be reported at the earliest to byteistic but within 24 hours. Any loss inured in this event does not make byteistic liable to pay any kind of compensation nor does it hold byteistic responsible for such events. You agree to operate one and only one account at our website, if you are found using multiple personal / entity accounts, the accounts shall be liable for suspension / termination / merger / fine which shall be decided by our staff when such events occur. In such cases, the account created first shall be considered the main account by default and other account (s) shall be considered as additional accounts.

Data Management and Transfer

At all times, you are hereby informed that we might share your data in masked / unmasked format with our providers / partners for various business purposes, such partners have the right to manage and operate the data as per their own data management policies and we shall not be responsible for the same. If you are visiting the website from any other country than the country in which our systems are placed your communication with us may result into the transfer of information (including account information) across international boundaries. By visiting the site and communicating with us electronically, you consent to such information transfer.

Website and Service Availibility

Subject to the terms and conditions of this agreement along with our uptime SLA policy, we shall use commercially accepted equipment and resources in the attempt to offer the site and services on a 24 hours a day and 7 days a week basis, it is however clarified that the site and services may not be available or be inaccessible or inoperable from time to time for periodic maintenance, updates, repairs and replacement in case of equipment failure that we undertake time to time with or without prior information or causes beyond our area of control such as natural calamity, network attacks, network congestion, telecommunication equipment failure at our service provider’s end or any such other failures. You acknowledge and agree that we have no control over the availability of the services and website on a continuous and uninterrupted basis and that we hold no liability to you or anyone else for service unavailability. You acknowledge and agree that you have the necessary rights and permissions to share all information necessary to provide the Services with byteistic. You acknowledge and agree that the Services may be provided by independent contractors or third-party service providers. All paid support services are non-refundable at all times.

Rules and Code of Conduct

You hereby acknowledge and agree that :

Your use of this Site and the Services, including any content you submit, will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations.
Websites hosted on the platform shall not collect or process user data in any form without their consent

You will not use the hosting, domain or any other service for the following use cases :

Illegal Website or promote or encourage illegal activity.
You will not use the hosting for mass storage, any media based file extension having total file size of over 90 GiB.
Hosting of any porn sites or websites of the same category.
Promote, encourage or engage in terrorism, violence against people, animals, or property or to promote communal violence of any type.
Promote, encourage or engage in any spam or other unsolicited bulk email, or computer or network hacking or cracking.
Promote, encourage or engage in the sale or distribution of prescription medication without a valid prescription.
Infringes on the intellectual property rights of another User or any other person or entity.
Site that beaches the privacy of any person intentionally or unintentionally.
To host clone sites of any kind or for falsely claiming to be the official website or any agency, service or institution.
Contains or installs any viruses, worms, bugs, Trojan horses, Cryptocurrency Miners or other code, files or programs designed to, or capable of, using many resources, disrupting, damaging or limiting the functionality of any software or hardware.
Contains false or deceptive language, or unsubstantiated or comparative claims, regarding Byteistic or Byteistic’s Services.

At the same time, you also confirm :

That you shall not dump data from our website or any other websites unless permitted by owner / organization to do so.
You understand that daily backups are not kept for lifetime but for a time frame of only 2 days, daily backups are subject to availability of the control panel without any logged in user, if a user is operating the panel at the time of backup systems running and trying to create control panel backup, the backup for the specific panel shall be skipped, we hold no responsibility of such events.
In case of backup system inactive due to maintenance, failure to function or due to any other reason, byteistic shall not be held responsible for any loss or / and damage incurred due to the same.
You agree to provide government / state issued photo id proof in un-masked format for verification if asked for. Failing to provide the same can result into account suspension and/or termination.
Byteistic associates can call you time to time in the working hours (9 Am to 7 Pm IST) for any kind of updates, promotions or reminders. Such calls may be subject to call recording which shall be informed prior to conversion initation with you. These recordings shall be presented as proof of conversation in legal cases or anywhere else if required and you have no issues with the same, you provide your free consent for the same.

Content and Account Monitoring

Byteistic reserves the right to login to your user panel and check the content of your site as well as the files hosted on the website. Our team reserves the right to do so and decide whether any item of User Content is appropriate and ensure that all contents complies with this Agreement. Byteistic may remove any item of User Content (posted on a website or kept in the control panel) and/or terminate a User’s access to the Services found at this Site for posting or publishing any material in violation of this Agreement. If for any reason, Byteistic’s team thinks that they need clarification from you in any reference to your website / control panel, we may suspend the service and block your access to it temporarily which might be unlocked and/or unsuspended upon submission of clarification from the client, failing to do so could result into service / account termination and the loss and/or damage incurred for the same shall not be put upon Byteistic in any way and we shall not be liable for any compensation.

Spam Control and Monitoring

By creating an account with us and by purchasing our services you agree not to use our services for any kind of spam activity. Spam in our policies is defined as Unsolicited Email Sending (Commercial or any other format), Unsolicited SMS or text message sending, Unsolicited FAX message. We shall not allow our servers to be used for any such activities and the user agrees to unconditionally follow the same. If any complaint for spam is received or if in case we discover the same being done, the service is liable for suspension and/or termination for which Byteistic shall not compensate for any loss or damage incurred. We encourage all customers and independent organisation / people to report suspected spam. Suspected abuse can be reported by email at [email protected].

Byteistic supports the rights for trademark and copyright protection for any organization. As the users have unrestricted access to the panel, we shall not be blamed for any such violation, however, we shall put our best foot forward to stop it upon receiving claims for the same. Copyright strikes and Trademark violations may be reported to us via email at [email protected] with all relevant proof of the violation as well as the proof of ownership of the Trademark and/or copyright material.

Data Managmenet at the End of Billing period

All users are required to maintain a minimum of net 0 overdue balance at all times with us. All hosting services shall be suspended if the payment is not made within 24 hours of the service expiry date, if a client fails to pay the invoice on time, we reserve the right to enforce a late payment charge ranging from 10% upto 35% of the current billing plan price which is to be paid additionally along with the plan price in order to get the services unsuspended. All backups of the site shall be locked from accessing as soon as the service is suspended. We shall not be able to hand over backup of any suspended service for the same. If the invoice is not paid within 7 days of service expiry, we shall have the right to unconditionally delete all the backups as well as terminate the service for which Byteistic shall not be responsible for any compensation for loss and/or damage incurred to the client.

Links to any 3rd Party Websites

AByteistic shall not be held responsible for any site containing any links of 3rd party website hosted on our servers. We assume no responsibility for the content, terms and conditions, privacy policies, or practices of any third-party websites. In addition, we also do not censor or edit the content of any third-party websites.

Data Leak Prevention

We understand that no data on the internet is 100 % secured, we however try our best to keep your data secured by using industry approved security measures. Under this, we may hire external professional organizations to manage the same and in such cases, the data will be shared to the 3rd party on need to know bases and the management of your data is then governed by their own privacy policy and we shall not be held responsible for the same at any instance of the time.

Indemnity

We are sure you will never need this. If in case there is a condition, we offer refund only for Yearly Plans within 7 days from date of activation of plan, if and only if there is a problem at our end which is not solved in 8 hrs from reporting of the error by the user.

Legal Proceeding

All cases / conflicts will be only dealt under the Indian jurisdiction to which the client / user agrees by using our services. Being an international brand, we will try to cope up with the laws of all countries where we work but this categorically does not mean that the client is free to follow the laws of any specific country except for the Indian jurisdiction.

Validation and Updates

This policy may also be applicable for any other site that we run in affiliation to byteistic. You are requested to check this page frequently for changes to the page. We might be able to inform you about the changes in the documents via any of our official communication methods.
